What the German software market looks like in 2026
Bitkom said in July 2026 that Germany’s IT and telecommunications market was expected to reach about €246.4 billion in 2026, with software, networks, AI hardware and cloud-related investment among the growth drivers. Bitkom’s July 2026 market update is the primary source.

Searches for “German software companies” can mean two different things. Product vendors such as SAP sell their own software, while custom software development companies build or modernize systems for clients. Buyers should separate those intents before comparing providers: if you need a product, compare software platforms; if you need a delivery team, compare engineering capability, ownership, security and support.

How to compare cost without being misled by hourly rates
Do not choose a provider from one hourly number. Ask every bidder whether discovery, architecture, QA, cloud setup, data migration, documentation, deployment and post-launch support are included. Third-party cloud, SaaS and AI-model charges should be separated from engineering fees.
Normalize proposals before comparing totals. GDPR and the EU AI Act
For personal-data projects, ask who is controller and processor, where data is stored, which subprocessors are used, and how deletion/export requests are handled. “GDPR compliant” should be backed by an actual data flow and contract.
The EU AI Act is also a current procurement issue. NIS2 security and public-sector procurement in Germany

Germany’s NIS-2 Implementation Act has been in force since December 6, 2025. The BSI says covered companies and public authorities must use its portal for the registration and incident-reporting duties that apply to them. If your project supports an in-scope organization, ask bidders how they handle vulnerability management, incident escalation, access control, logging, supplier risk, backups and evidence needed for security governance. For federal public-sector work, procurement route and contract model can matter as much as engineering capability. Germany’s Federal Ministry for Digital Transformation and Government Modernisation says it now centrally coordinates federal IT purchasing strategy and the digital transformation of public procurement, with the goal of buying IT products and services legally, efficiently and with lower dependency risk. Buyers should confirm tender eligibility, required contract terms, security conditions, sovereignty or hosting requirements, and whether an existing framework or central procurement route applies before treating a commercial proposal as procurement-ready. For open-source software in public administration, contract structure is also evolving. In March 2026, BMDS and Bitkom published updated standardized contractual terms intended to make open-source procurement more legally consistent. If an open-source stack is proposed, confirm licensing, maintenance responsibility, security patching, support, contribution obligations and handover terms in the tender and contract. Cyber Resilience Act: a new 2026 software-procurement check
The EU Cyber Resilience Act now matters directly to some software buying decisions. Its main product-security requirements generally apply from December 11, 2027, but the Act’s Article 14 reporting duties started on September 11, 2026. The European Commission says manufacturers of products with digital elements must report actively exploited vulnerabilities and severe security incidents through the CRA Single Reporting Platform, with an early warning within 24 hours and a fuller notification within 72 hours. For a German software project, do not assume every custom application automatically creates the same CRA obligations. Instead, establish whether the deliverable is a product with digital elements placed on the EU market, who will hold the manufacturer or other economic-operator role, and who owns post-release vulnerability handling. If the project is in scope, the contract should make responsibilities explicit rather than leaving them to a generic “security support” clause.
Ask shortlisted vendors how they handle vulnerability intake and triage, security fixes, third-party and open-source dependencies, software bills of materials where appropriate, support periods, incident evidence, and escalation when an actively exploited vulnerability is discovered. Also define who can file regulatory notifications, who maintains customer and dependency records after launch, and what happens to those responsibilities if the development partner exits. The Commission’s July 2026 CRA guidance confirms that the broader obligations are still being phased in, so buyers should separate requirements already in force from those beginning in 2027.
