China’s amended Cybersecurity Law took effect on January 1, 2026. For software buyers, that makes security due diligence part of vendor selection rather than an afterthought—especially for systems that operate networks, process sensitive data, support critical infrastructure or use AI. The law strengthens cybersecurity responsibilities and adds explicit AI-safety provisions, but the exact obligations still depend on the buyer, system and sector.
Questions to put in the RFP: How are vulnerabilities reported and remediated? Which administrators receive privileged access? How are software dependencies and open-source components tracked? What logging and incident-escalation evidence is available? Which subcontractors or offshore teams can reach production systems? What recovery, credential-revocation and secure-exit steps apply when the engagement ends?
For connected products, dedicated cybersecurity products or regulated environments, buyers should also verify whether product-specific testing, certification, labelling or sector requirements apply instead of assuming a general software-development contract covers them.

Public-sector and AI procurement checks in China
Government and public-sector software buying in China can involve formal procurement platforms, qualification requirements, tender documents and sector-specific security conditions. Current 2026 notices on the China Government Procurement Network show software, cloud and systems-maintenance projects being purchased through open tendering or competitive consultation, often with explicit technical, security, support and supplier-eligibility requirements. Public buyers should verify the applicable national, central-agency or local procurement route before treating a normal commercial proposal as bid-ready.
AI-enabled software also deserves a separate compliance check. China’s Interim Measures for the Management of Generative Artificial Intelligence Services have applied since August 15, 2023. For projects using generative-AI services, buyers should clarify whether the proposed model or service is public-facing, what data is submitted to it, how personal information and confidential code are protected, whether outputs are logged, and which party is responsible for required security, content and operational controls.

How to compare Chinese software-development proposals
Give every shortlisted vendor the same business context and ask for comparable answers. At minimum, compare:
- Actual team: names or roles, seniority, employment/subcontracting status, location and replacement rules.
- Scope: assumptions, exclusions, dependencies, discovery work and acceptance criteria.
- Delivery model: fixed price, time and materials, dedicated team, managed delivery or paid discovery.
- Architecture: who makes technical decisions and how they are documented.
- Quality: code review, automated testing, performance testing, security testing and release approval.
- AI governance: which AI coding or model services may interact with your source code, prompts or data.

Local China team or distributed delivery?
